TERMS AND SERVICES AGREEMENT

1. Applicability and Legal Framework
These Terms apply to all offers, agreements, and deliveries made by us to you (the "Customer"). These Terms are governed by Belgian law, including the Belgian Code of Economic Law (Wetboek van economisch recht / Code de droit économique) and the General Data Protection Regulation (GDPR).
2. Offer and Formation of Agreement
  • Product Descriptions: All descriptions, pricing, and images of products on our Website are as accurate as possible. However, minor variations may occur.
  • Order Acceptance: An agreement is officially formed only when we send you an email confirmation accepting your order.
  • Right to Refuse: We reserve the right to refuse or cancel any order for legitimate reasons, such as suspected fraud, stock limitations, or incorrect pricing.
3. Prices and Payment
  • Currency and Taxes: All prices are listed in Euros (€) and are inclusive of Belgian VAT (belasting over de toegevoegde waarde / TVA) unless stated otherwise. Shipping costs are displayed clearly before checkout.

4. Delivery and Shipping

5. Legal Right of Withdrawal (Herroepingsrecht / Droit de rétractation)
In accordance with Belgian and EU consumer law, you have a legal right to withdraw from this contract within 14 days without giving any reason.
  • Withdrawal Period: The withdrawal period expires 30 days from the day you, or a third party designated by you, physically receive the goods.
  • Notification: To exercise this right, you must inform us of your decision via an unambiguous statement by emailing support@omnimarkett.com.
  • Return of Goods: You must send back the goods or hand them over to us without undue delay and no later than 30 days from the day you communicate your withdrawal. You must bear the direct cost of returning the goods.
  • Refunds: We will reimburse all payments received from you, including standard delivery costs, within 30 days of receiving your withdrawal notice. We may withhold the refund until we have received the goods back or you have supplied evidence of shipping them back.
  • Exceptions: The right of withdrawal does not apply to sealed goods that are not suitable for return due to health protection or hygiene reasons if unsealed after delivery, or custom-made items.
6. Statutory Warranty (Wettelijke Garantie / Garantie Légale)
  • 2-Year Warranty: Consumers in Belgium are entitled to a legal 2-year warranty for conformity of consumer goods.
  • Defective Products: If a product is defective or does not match the description within two years of delivery, you must notify us within 2 months of discovering the defect. We will repair, replace, or refund the item at no extra cost to you.
7. Privacy and Data Protection

8. Intellectual Property

11. Applicable Law and Jurisdiction
These Terms are governed by and construed in accordance with Belgian law. Any disputes arising from these Terms that cannot be settled amicably shall be submitted to the exclusive jurisdiction of the competent courts in the judicial district where our company is registered.
