TERMS AND SERVICES AGREEMENT

By accessing or using our Website and purchasing our products, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully before placing an order.
1. Applicability and Legal Framework
These Terms apply to all offers, agreements, and deliveries made by us to you (the "Customer"). These Terms are governed by Belgian law, including the Belgian Code of Economic Law (Wetboek van economisch recht / Code de droit économique) and the General Data Protection Regulation (GDPR).
2. Offer and Formation of the Agreement
  • Product Descriptions: All product descriptions, prices, and images on our Website are as accurate as possible. However, minor variations may occur.
  • Order Acceptance: An agreement is officially formed only when we send you an email confirmation accepting your order.
  • Right to Refuse: We reserve the right to refuse or cancel any order for legitimate reasons, such as suspected fraud, limited stock, or incorrect pricing.
3. Prices and Payment
  • Currency and Taxes: All prices are listed in euros (€) and include Belgian VAT (value-added tax / TVA) unless otherwise stated. Shipping costs are clearly displayed before checkout.

4. Delivery and Shipping

5. Legal Right of Withdrawal (Right of Withdrawal / Droit de rétractation)
In accordance with Belgian and EU consumer law, you have the legal right to cancel this contract within 14 days without providing a reason.
  • Withdrawal Period: The withdrawal period expires 30 days from the day you, or a third party designated by you, physically receive the goods.
  • Notification: To exercise this right, you must notify us of your decision by sending an unambiguous statement via email to support@omnimarkett.com.
  • Return of Goods: You must return the goods or hand them over to us without undue delay and no later than 30 days from the date you notify us of your withdrawal. You must bear the direct cost of returning the goods.
  • Refunds: We will reimburse all payments received from you, including standard shipping costs, within 30 days of receiving your notice of withdrawal. We may withhold the refund until we have received the goods back or you have provided proof that you have shipped them back.
  • Exceptions: The right of withdrawal does not apply to sealed goods that are not suitable for return for health or hygiene reasons if they have been unsealed after delivery, or to custom-made items.
6. Statutory Warranty (Wettelijke Garantie / Garantie Légale)
  • 2-Year Warranty: Consumers in Belgium are entitled to a statutory 2-year warranty regarding the conformity of consumer goods.
  • Defective Products: If a product is defective or does not match the description within two years of delivery, you must notify us within 2 months of discovering the defect. We will repair, replace, or refund the item at no extra cost to you.
7. Privacy and Data Protection

8. Intellectual Property

To the maximum extent permitted by Belgian law, we shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Website or the purchase of our products. Our maximum liability shall not exceed the amount you paid for the product in question.
10. Complaints and Dispute Resolution

  • Online Dispute Resolution: If we are unable to reach a resolution, EU consumers can submit complaints to the European Commission’s Online Dispute Resolution (ODR) Platform.
  • Belgian Consumer Mediation: You can also contact the Belgian Consumer Mediation Service (Consumentenombudsdienst / Service de Médiation pour le Consommateur).
11. Applicable Law and Jurisdiction
These Terms are governed by and construed in accordance with Belgian law. Any disputes arising from these Terms that cannot be settled amicably shall be submitted to the exclusive jurisdiction of the competent courts in the judicial district where our company is registered.
